Consumentbond

Data Privacy Stichting enjoys the support of Consumentenbond, the largest organization in the Netherlands that stands up for the interests of consumers. With its large network of members, Consumentenbond advocates fair, just and safe markets and combats consumer wrongdoing. Safeguarding consumers’ right to privacy is a high priority on Consumentenbond’s agenda.

In the context of the two Actions, the Foundation and Consumentenbond have jointly called on members of the constituency to support the Actions via Consumentenbond’s website. The Foundation and Consumentenbond formalized their relationship and entered into a cooperation agreement in March 2020. With the support of Consumentenbond, the Foundation is working to put an end to Meta’s unlawful practices and to obtain compensation for affected Facebook and Instagram users.

Lemstra Van der Korst N.V. advises the Foundation on various legal matters and acts as counsel in the legal proceedings against Meta for its violations of data protection and consumer law.

Pels Rijcken & Droogleever Fortuijn N.V. acts as the Foundation’s counsel with regard to substantive legal issues regarding Meta’s privacy violations in the Netherlands.

Lieff Cabraser Heimann & Bernstein, LLP, the Funder, is a leading U.S. law firm that funds the Foundation’s activities that are related to the Actions against Meta. For this purpose, the Foundation and the Funder have entered into a financing agreement. The Funder bears the full financial risk of the two Actions. The Board of the Foundation determines the policy and operates independently from the Funder. The Funder can, alongside the Foundation, in addition to the financial support, also assist with marketing activities, operating this website and by sharing advice and information on other topics, but only if and to the extent that the Foundation instructs it to do so. In exchange for the funding and the services it can provide, the Funder will be eligible to receive a litigation funding fee (up to 18% of the net proceeds, plus expenses). This compensation is only due if the Foundation obtains compensation for Aggrieved Parties. If no compensation is obtained, no payment is due to the Funder.

In addition, the Funder has concluded a financing agreement with Consumentenbond, on the basis of which the Funder compensates Consumentenbond for its efforts in the interests of the Aggrieved Parties. The Funder also has no influence on Consumentenbond’s policy. The Consumentenbond operates independently from the Funder.

Consumentenbond Claimservice, CCS, has been commissioned by the Foundation to facilitate and set up the registration process, maintenance and support of participants. Since CCS has a mandate from the Foundation, CCS collects the personal data of participants on behalf of and under the responsibility of the Foundation. This means that the Foundation remains responsible for the data of participants and that CCS is the processor on behalf of the Foundation.
